Cressida Custody Hearing Results

The three High Judges at last's night's hearing made the following decision:

1. Cressida will stay in the custody of the Royal Guard.

2. Trinsic may send an officer to provide additional security if it wishes.

3. Trinsic must provide a representative to work with the King's Counsel to come up with a unified and complete list of charges.

4. The charge of possession of Blackrock will remain on the charge list, but special attention will be given during the trial to the fact that this is a local law.

5. Should Cressida be convicted of any crimes where the punishment is execution, she will be executed in Trinsic.

The Territory of Trinsic has no issue with the Royal Guard maintaining custody of Cressida at this time.

Trinsic does not see the need to send additional security as it has confidence that the Royal Guard is quite cabable of maintaining security.

Trinsic will supply a representative to work with the King's Council to develop a unified list of Charges.

However prior to Trinsic retaining a representative some clarification would be required.
Clarification on the charge dealing with the possession of BlackRock in paticular.
What does the High Court define the term "special attention will be given during the trial to the fact that this is a local law"as being?

This is the most serious charge that Trinsic has placed upon Cressida and it could potentially carry a sentence of public execution.
Depending upon what the High Court's meaning is being implied by the term "special attention" will be a determining factor in if Trinsic wishes to pursue this paticular charge against Cressida at the High Court or withdraw the charge to be implimented at a later date locally.

Trinsic would be quite reluctant to allow any executions to be carried out within the Territory of Trinsic that are not associated with crimes commited within the borders of Trinsic and concidered punishable by death according to the Laws in place at this time in the Territory of Trinsic.

On the matter of Trinsic's Blackrock Law:

"The High Court is empowered and entrusted with the responsibilities of ruling on the validity of laws and their enforceability, and hearing criminal cases."

This is from the Council's charter, and the High Court's charter (which really needs to be updated) says something similar. All local laws must be in the spirit and not in conflict with the standing laws of the rest of the realm. Because there is no High Council law concerning Blackrock, the Court is required to examine this local law itself. In this judge's opinion, I don't think there is a problem with it, but this law's status may come up during the trial. Proving anything about this law rests on the advocate's shoulder. I also know of no case where a local law was nullified by the High Court.

Even if Cressida faces the charge locally, her advocate could still appeal the decision. Also by doing a separate trial, there may be problems with double jeopardy which goes against Article IV of Justice.

As for the execution, the Court will offer the action to Trinsic first, but Trinsic is welcome to pass off the task.

Thank you for the clarifications.
Trinsic shall procede with the High Court and shall allow the outcome of this trial determine the validity of The BlackRock Law in place within the Territory of Trinsic.
